The Business Portrait Studio

Definitions
“The Business Portrait Studio” or “The Business Portrait” refers to The Business Portrait photography studio, Glasgow. “The client” means any person, body of persons, Publication, Agency or Company with whom The Business Portrait Studio enters into a contract, verbal or written, for the sale of goods or provision of services by The Business Portrait Studio. “Portrait session” refers to the service in which the client has their photograph taken by The Business Portrait Studio. “Headshot” refers to the photographs taken in the portrait session by The Business Portrait Studio as outlined below.

Acceptance of Terms and Conditions
All contracts and transactions between The Business Portrait Studio and the Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between The Business Portrait Studio and all or any of its Clients. Terms and conditions will be effective as of booking and carried out from the start of each portrait session.

Services
Services and goods consist of photography headshots carried out by the photographer working under the name of The Business Portrait Studio, with the outcome of the work from each photography session being digital files which will be transferred electronically through the clients preferred digital and electronic transfer service. This also includes further prints requested by the client on receipt of the digital files.

Copyright, Usage, Ownership & Licence
Photographs are the exclusive property of Rachel Byrne trading as The Business Portrait Studio and are protected under international Copyright, Designs & Patents Act 1988. The copyright of all photographs taken by The Business Portrait Studio is retained by The Business Portrait Studio and cannot be used by a third-party organization unless pre-agreed with The Business Portrait Studio. No use may be made of the images until payment is made in full; thereafter payment the license terms default to the terms outlined in the individual client's invoice. Rights and usage fees vary for each project.

Exclusivity
The Business Portrait Studio retains the right in all cases to use the photographs taken in each session for purposes none other than promoting their own work across all of The Business Portrait Studio’s social media channels and website. Permission will always be asked whereby their image is used beyond the channels stated above. No client’s portrait will be used in any public advertisement without their prior written consent.

Client Confidentiality
The Business Portrait Studio will keep confidential and will not disclose to any third parties or make use of material or information communicated to them in confidence for the purposes of the portrait session.

Expenses
Expenses are estimated at the time of commission and charged at cost. Where extra expenses or time are incurred by The Business Portrait Studio as a result of alterations to the original brief by the client or otherwise at their request, the client shall give approval to and be liable to pay such extra expenses or fees at The Business Portrait Studio’s normal rate in addition to the expenses agreed or estimated.

Refunds
The utmost care and attention to detail will be taken in the photographing and processing of each portrait session, however, due to the artistic nature of photography, the client has no right to request a refund of the final outcome of their portrait session with The Business Portrait Studio. Refunds will not be granted in any case.

Day Rates & Overtime.
Where payment is based on hourly work, the rate of The Business Portrait Studio/ Rachel Byrne will be £200/ hour unless otherwise discussed. A full day of shooting is up to 6 hours not including set up and pack away time. A half day is 3 hours, not including set up and pack away time. Working beyond this time frame will be classed as over time and therefore will be charged at £250 per hour unless otherwise negotiated. The client will be notified prior to reaching the overtime threshold.

Payment
Payment for all charges is expected within 24 hours of booking a headshot with the Business Portrait Studio. Failure to pay within 24 hours will result in the booking slot being released and may be given to another client. Booking will not be confirmed until the payment is processed. Photographic editing and processing will not begin until the client's payment has been processed (should alternate payment time be agreed upon.)

Student Discount
Student discount offer is only for students and those having graduated 1 year maximum from their shoot booking. Those booking and sitting for the sitting for the student discount price MUST have a VALID Student ID or proof of studying and/ or graduating within 1 year (365 days.)

Delivery time
Each portrait session will vary in time, though the average individual session can last from 15minutes up to 1 hour. Delivery of the client's photographs will come no later than 2 weeks from their payment date. For group sessions larger than 3 people, expect the delivery of the final outcome to be up to three weeks after the payment date. Each group session will take around 5-15 minutes per person. The reserves the right to extend the picture return date, but the client will ALWAYS be notified before shooting in this case.

Termination
On-site, the Photographer reserves the right to terminate any photographic session without notice if they deem the client’s behaviour to be disrespectful or unsafe.

Cancellation
In any case where the client cannot honour the booking schedule, they must call or email The Business Portrait Studio at least 48 hours in advance to give notice. Failing to do will cost their deposit (£40.)

High-Speed Services
The Business Portrait Studio reserves the right to make an additional charge of £45 should the client request a “high-speed” service in which the delivery of their photographs is faster than the above stated time frame. This service is subject to availability and cannot be guaranteed due to the workload at the time of this service request.

Travel Expenses
Public transport, including but not limited to taxi, train, ferry, and aeroplane are charged at the cost of travel in cases where the photographer is required to travel to the client. In any case where travel expenses will be charged, The Business Portrait Studio will notify the client beforehand.

Images/Data Supplied in Electronic Format
For all images/data supplied to the Client in electronic format (including but not limited to electronic mail, WeTransfer, and pen drive, etc.), The Business Portrait Studio will endeavour to do everything in its power to ensure that the data sent is not corrupt and is virus-free before despatch.
The Business Portrait Studio cannot be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the Clients computer or data. The Client agrees to take similar steps to ensure that data sent to The Business Portrait Studio is not corrupt.

Applicable Law
This agreement shall be governed by the laws of England, Wales, and Scotland.

Variation
These Terms and Conditions shall not be varied except by agreement in writing.
